TERMS AND CONDITIONS

1. THE AGREEMENT

These general conditions form an inseparable part of the treatment agreement pursuant to article TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP and the client, hereinafter referred to as the Agreement.

2. PERFORMANCE OF THE AGREEMENT
  1. TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP guarantees that the activities it performs under this Agreement meet the standards that a good care provider should observe and are in accordance with the statutory provisions (including the WGBO) as well as the generally applicable guidelines.
  2. Dental treatments fall under medical/medical treatments. The (dental) doctor has an obligation of effort and not an obligation of result.
  3. TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP is entitled to engage third parties in the performance of the Agreement. TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP is not liable for the conduct of these third parties.
  4. Client shall at all times inform TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP fully and truthfully regarding the client’s general health and regarding circumstances that may affect treatment.
3. COST
  1. The costs of dental treatment are declared in accordance with the applicable UTP rates as set by the NZa and laid down in the Tariff Decision Dental Care (www.NZa.nl).
  2. The price list for dental care can be viewed on the websites of TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP mentioned in the preamble. Rates may be adjusted from time to time.
  3. For all treatments totaling EUR 250 or more, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP will provide an estimate prior to treatment.
  4. In case of necessary modification of the treatment due to unforeseen complications during the treatment, resulting in exceeding the budget, after consultation with the client, the additional costs to be incurred will be charged to the client.
  5. Technician fees are charged separately. At the request of the client or his insurer, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP will provide the specification of this.
  6. Up to 2 years after treatment, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP may bill or change the code retroactively.
4. CANCELLATION OF APPOINTMENTS
  1. Established appointments may be rescheduled or cancelled by client at no charge up to 48 hours prior to the scheduled time. If the appointment is not or not timely rescheduled or canceled, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP will charge the reserved time and / or agreed treatment with code C90, taking into account the duration of the planned treatment, for which reference is made to the price list which can be found on the websites mentioned in the preamble.
  2. TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP is authorized at all times to reschedule or cancel established appointments with the client.
5. CANCELLATION OF TREATMENT

If the client, after a treatment agreement is established, cancels the treatment in whole or in part, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP is entitled to charge the client in full for all costs incurred in connection with that treatment by her and by third parties.

6. DECLARATION
  1. Infomedics takes care of the declarations for TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP. This is subject to the Infomedics payment terms and conditions. These payment terms are filed with the Amsterdam Chamber of Commerce. The payment terms are also available for inspection at TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP, are on the TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP website and are available from Infomedics (www.infomedics.nl).
  2. If bills are no longer accepted by Infomedics due to the client’s payment arrears, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP is entitled to suspend further treatment, or to carry it out only against immediate payment by the client.
7. RECLAME
  1. Complaints about the work performed or the invoice must be reported in writing by the client to TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP within 30 days of discovery, but no later than three months after completion of the work in question.
  2. A complaint, as referred to in the first paragraph, does not suspend the client’s payment obligation.
    3. The complaint will be handled by TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP according to the Complaints Procedure of the Royal Dutch Dental Association.
  3. If a complaint is justified and recovery is possible, TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP will still perform the work as agreed.
8. LIABILITY
  1. Rights to compensation for liability, expire after 1 year after the damaging event occurred.
  2. Client cannot derive any rights from the calculation made by Zorgsom.
9. APPLICABLE LAW
  1. All agreements between the client and TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP are governed by Dutch law.
  2. All disputes related to the Agreement between client and TANDARTSPRAKTIJK RAADHUISPLEIN HOOFDDORP, to which these general terms and conditions apply, shall be settled by the court in Amsterdam.
10. OTHER PROVISIONS

If any provision of these general terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions.
